How much time to take divorce?

Under present circumstances, you will not get divorce immediately as your husband is likely to contest divorce petition that you may file in court. Therefore, firstly, it is necessary to throw your husband and mother in law out of your house. You lodge F. I. R. to the police against your husband and mother in law u/s 498 A of I. P. C. As your brother is owner of the house and has given power of attorney to you, you are entitled to prevent your husband and mother in law from entering in your home as they are torturing you. You have another remedy of filling petition under Domestic Violence Act and take order from the court for preventing them from entering your house. You can get the order under Domestic Violence Act within 3-4 months. You may take free legal aid also. When your husband and mother in law will suffer, your husband will be automatically ready to take divorce mutually. Even if your husband does not show readiness to take divorce mutually, court may grant your prayer of divorce if it is satisfied that you have genuine grounds for divorce. Once your husband and mother in law are thrown out of your home, you will have no problem to wait for some time which may take to get divorce. Don't try to settle the matter by giving money to your husband in any case, as it will create permanent headache for you. Actually, your husband should be grateful to you, as you are not expecting anything from him.
